In July 2024 the CEO of the Zionist Federation of Australia (ZFO) filed a complaint with the Australian Human Rights Commission (AHRC), using 18C of Australia’s Racial Discrimination Act (RDA). Alleging Mary Kostakidis is antisemitic, he accuses her of ‘hate speech’, and alleges two of her posts on X (twitter) are unlawful and offensive. He demanded an apology, removal of all ‘offensive’ posts, an undertaking not to repeat ‘the conduct’ and payment of his legal fees. The 2 posts alleged to be unlawful can be found in the Two Retweets link.
The AHRC administers the RDA, but it is not a court, so cannot make a finding. It can attempt to conciliate. Mediation was unable to resolve the matter. Mary published a statement to her X account on 2 January 2025:
We at Stand With Mary, agree with esteemed Australian jounalist Peter Cronau, when he says
The CEO of the ZFO responded the same day, though he claimed Mary had apologised for her posts when her apology was for any offence taken and any distress caused:
The AHRC terminated the complaint, and 60 days on 31 March the Complainant filed in the Federal Court.
This law-fare is aimed at silencing Mary’s extensive sharing of images from Gaza, her criticism of the Israeli regime and the Australian government’s failure to take appropriate action against the apartheid state. despite the Orders of the International Court of Justice and Australia’s obligations under the Genocide Convention.
The ICJ has stated Israel is committing genocidal acts and the International Criminal Court (ICC) has issued arrest warrants for Israeli leaders.
On the X platform, Mary shares investigative reports and commentary from esteemed independent journalists, experts and scholars including a range of Jewish historians and commentators from around the world as well as from within Israel.
